General terms and conditions

DRAGON KIDS SCHOOL

It is hereby specified that the present conditions exclusively govern sales by Dragon Kids School (Head Office: Parc d’activité de la Ravoire Impasse de la Ravoire 74370 EPAGNY METZ-TESSY) of editorial products (books, etc.). These conditions apply to the exclusion of all other conditions.

1-Purpose

These General Terms and Conditions of Sale govern the contractual relationship between the company (hereinafter referred to as “Dragon Kids School”) and the customer. Any registration and use of the services provided by Dragon Kids School implies unreserved acceptance of these general conditions of sale, which shall prevail over any other general or special conditions not expressly approved by Dragon Kids School.

2-Services

The services are provided in the form of animation sessions at the “Dragon Kids School” educational centers. All courses are taught by Dragon Kids School instructors. The pedagogical project is essentially based on foreign language immersion, which enables children to be in contact with the language in a playful setting, while practicing sports, artistic, cultural and manual activities.

Dragon Kids School reserves the right to cancel an annual workshop (at the beginning of or during the year), a vacation course or a session if fewer than 5 children are registered. The customer will be informed at least one week in advance for an annual workshop, or 48 hours in advance for a session or vacation course. If an annual workshop or vacation course is cancelled by Dragon Kids School, the corresponding amount will be refunded in full. If cancellation occurs during the course of the year, reimbursement will be made on a pro rata basis for the remaining sessions. If a session is cancelled, it will be rescheduled for a later date, if possible by mutual agreement between the parties; if Dragon Kids School is unable to reschedule a session that has been cancelled, the corresponding fee will be reimbursed in full.

As Dragon Kids School workshops are all-inclusive (year-round) activities, no refunds or adjustments can be made for sessions missed due to strikes or other reasons. This is also the case when a child is absent (even with a medical certificate).

3-Availability of animators

As part of our Quality Assurance approach to our instructors, and in order to accustom children to a variety of accents and pronunciations, changes in instructors may occur. There is no right to have a workshop led by a specific instructor.

4-Price

The prices indicated on the price brochures are inclusive of all taxes, taking into account the VAT applicable on the day of registration; any change in the rate may be reflected in the price of services.

5-Payments

Payment is due in full on the day of registration. Payment can be made by cheque or bank transfer, although in the latter case a processing fee per registration will be charged in addition (please refer to the specific brochure provided on request for details of the amount and terms). Payment by cheque can be made in one, two or three instalments, as follows: a first cheque for the amount of the registration fee, cashed at the time of registration, and one or two cheques for half the balance, also cashed at the time of registration: for amounts and cashing procedures, please refer to the price brochure for the year corresponding to that of registration.

Any delay in payment will result in the application of interest on arrears of 12% per annum and a penalty clause of 15% on the principal amounts due. Dragon Kids School also reserves the right to take legal action to enforce its rights.

6-Registration

Registration becomes definitive only after payment has been made in accordance with the conditions set out in point 5 above.

7-Cancellation

No cancellation will be accepted for any reason whatsoever. For annual registrations, all cancellations must be notified by registered letter with acknowledgement of receipt to the following address:

Subject to compliance with this procedure, any cancellation of registration received before the fourth session, as evidenced by the postmark, will be reimbursed within 90 days, after deduction of the registration fee and the public price of the annual course included in the subscription, if any, which will remain the property of Dragon Kids School. Public price means the price excluding any special or promotional offers.

On the other hand, enrolment will be definitive from the fourth session onwards, and no cancellation will be possible except in the case of force majeure duly justified by the customer and subject to the discretion of Dragon Kids School. In this case, only the registration fees and the sessions and courses provided will be due, the values retained being those of the public price excluding special or promotional offers. The balance will be reimbursed within 90 days.

8-Right of withdrawal

The customer has 14 days to exercise his right of withdrawal. To exercise the right of withdrawal, the customer must inform Dragon Kids School by registered letter with acknowledgement of receipt sent to Dragon Kids School, Parc d’activité de la Ravoire Impasse de la Ravoire 74370 EPAGNY METZ-TESSY, within 14 days of registration (date of signature on the registration form). If the customer wishes the service to begin before the 14-day cooling-off period, he/she must expressly request this from Dragon Kids School. Customers who have exercised their right to withdraw from a service or contract that has begun at their express request before the end of the withdrawal period must pay Dragon Kids School the amount corresponding to the services already provided up to the date of communication of their decision to withdraw. This amount is proportional to the total price of the service agreed in the contract. The customer’s right to withdraw from the contract is lost if the service has been fully executed within the 14-day period at the customer’s express request.

9-No solicitation

The customer undertakes not to directly or indirectly solicit the teaching staff employed by Dragon Kids School and not to use their services for any mission other than that entrusted to them by Dragon Kids School.

10-Delay

Dragon Kids School reserves the right to charge the customer a fixed fee of 9 euros (incl. VAT) per 15-minute session, in the event that a childcare provider is obliged to keep a child beyond the scheduled time of the session due to the late arrival of the person responsible for collecting the child from the learning center, regardless of the reason for the delay.

Parents agree to be punctual when dropping off and picking up their children. Children are looked after during workshop hours. Outside these hours, parents are solely responsible for their children.

11-Conduct Discipline

In the event of persistent behavior on the part of a child that is detrimental to the proper conduct of the workshops, Dragon Kids School reserves the right to exclude the child temporarily or permanently, after an initial warning to the parents has had no effect. Payment for the service contracted will remain due in full to Dragon Kids School.

12-Warranty and liability

Dragon Kids School declines all responsibility in the event of non-achievement of the children’s learning objectives. In this respect, Dragon Kids School is only bound by an obligation of means.

13-Image rights

Unless otherwise decided by the parents, Dragon Kids School is authorized to photograph or film children during group activities, for the sole purpose of publication on the Dragon Kids School website or in the mass media. Any refusal or limitation of such broadcasting must be mentioned on the registration form.

14-Materials – Intellectual Property

All materials (books, magazines, computer equipment, etc.) made available and used by Dragon Kids School remain its exclusive property. The services are provided under brands and know-how for which Dragon Kids School regularly holds the rights of use. All elements relating to the content of the services and on the Dragon Kids School websites are and remain the exclusive intellectual property of their owner. It is strictly forbidden to reproduce, exploit, redistribute or use in any way, for any reason, even partially, these elements in any language, form, medium or format whatsoever, without the prior written consent of Dragon Kids School.

15-Insurance

Dragon Kids School is regularly insured for professional liability. However, Dragon Kids School cannot be held responsible for the loss, theft or breakage of children’s personal belongings.

As part of their activities at the centers, families agree to take out civil liability insurance for children enrolled at Dragon Kids School.

16-General Data Protection Regulation:

The information collected on this form is recorded and processed in a computerized file by DRAGON KIDS SCHOOL for the purposes of their legitimate interests in managing their customers and prospects. It is kept for 3 years and is intended for use by the teaching, administrative and sales teams.

When the information collected concerns a child, it is collected for the child’s safety and comfort and the child’s parents or guardians authorize DRAGON KIDS SCHOOL, in the child’s interest, to collect and process the child’s personal data.

In accordance with the French Data Protection Act of January 6, 1978, customers and prospective customers have the right to access and rectify their personal data by contacting Dragon Kids School Customer Service, Parc d’activité de la Ravoire Impasse de la Ravoire 74370 EPAGNY METZ-TESSY.

18-Jurisdiction

These terms and conditions of sale are governed by French law. The contractual information and the products offered for sale comply with French legislation. Any dispute arising from the application of these terms and conditions of sale shall be submitted to the competent courts.
